SCOPE AND CUSTOMER BASE
These General Terms and Conditions (GTC) apply exclusively to orders placed by customers via our online shop http://www.radubaias.com (hereinafter Radu Baias Design Store). We do not recognize any differing terms and conditions of the customer or third parties unless we have expressly agreed to their validity.
The products and services offered in the Radu Baias Design Store are exclusively aimed at consumers (any natural person who enters into a contract for purposes which are neither related to their commercial nor their independent professional activity, § 13 BGB).
OFFER AND PRICES
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. Offers from Radu Baias Design Store are subject to change and non-binding unless expressly designated as binding offers. The order confirmation from Radu Baias Design Store is decisive for the order; the customer must object immediately to any discrepancies, otherwise the contract will be concluded in accordance with the order confirmation. The prices stated in the order confirmation, or, if no order confirmation is issued, the prices stated in the currently valid price list, are decisive. All prices quoted here include the legally required value-added tax of 16%.

PAYMENT
Prepayment: You can pay in advance. To do so, transfer the invoice amount specified during the ordering process to the designated account. If you select prepayment as your payment method, we will provide you with our bank details in the order confirmation and deliver the goods after receipt of payment.
PayPal: PayPal is an online payment method that works by linking your bank account or credit card. To pay with PayPal, you need a PayPal account. If you don't yet have a PayPal account, you can create one during the checkout process.
Credit card: If you wish to pay by credit card, please select the appropriate card during the order process and enter the required information in the fields provided. Your credit card will be charged immediately after we confirm your order. Credit card payments are processed by Stripe.
DELIVERY
Delivery will be made within the delivery period shown on the respective offer page to the delivery address you provided via DHL. The period relevant for determining the delivery date begins, in the case of payment in advance, on the day the full purchase price (including VAT and shipping costs) is received; in the case of payment via PayPal, as soon as the payment is received by PayPal; and in the case of payment by credit card, upon receipt of the order confirmation. You will receive your order in a single shipment whenever possible. Should separate shipments be necessary for technical or logistical reasons, for example, because your order contains items that must be packaged or transported separately, you will not incur any additional costs.
RETURN POLICY
You can return the received goods within 14 days without giving any reason by sending them back. The period begins after receipt of the goods by the recipient. Timely dispatch of the goods or the return request is sufficient to meet the deadline. You, as the buyer, bear the return postage costs. The return or return request must be sent to:

In the event of a valid return, both parties must return any goods or services received. If the goods have deteriorated, or if benefits derived from their use cannot be returned in whole or in part, or only in a deteriorated condition, you must compensate us accordingly. You are only required to compensate us for deterioration of the goods and for benefits derived from their use if the deterioration or use is due to handling of the goods beyond what is necessary to ascertain their nature, characteristics, and functioning. "Ascertaining the nature, characteristics, and functioning" means testing and trying out the goods as is possible and customary in a retail store. Refunds must be processed within 14 days. This period begins for you when you send the goods or the return request, and for us upon receipt.
Exclusion or premature expiry of the right of withdrawal:
The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive or which are clearly tailored to the personal needs of the consumer (personalization in the form of embossing on the product).
RETENTION OF OWNERSHIP
The goods remain our property until full payment is received.
WARRANTY
In the event of defects in the delivered goods, the statutory rights apply. In accordance with the obligation to give notice of defects pursuant to Section 377 of the German Commercial Code (HGB), the customer must inspect the goods immediately upon receipt and notify Radu Baias Design Store in writing of any apparent defects without delay. Hidden defects must be reported to Radu Baias Design Store in writing immediately upon discovery. Otherwise, they are deemed accepted.
In the event of defects, Radu Baias Design Store may first provide the customer with a new, defect-free product or remedy the defect through repair before the customer can assert further rights under Sections 434 et seq. of the German Civil Code (BGB). If the unsuccessful expiry of a deadline or grace period set by the customer is to result in termination of the contractual relationship or a reduction in remuneration, this must be expressly threatened by the customer in writing when setting the deadline. The deadline must be set in such a way that it allows Radu Baias Design Store at least two attempts at rectification.
The warranty period is 12 months from delivery.
APPLICABLE LAW
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory international consumer protection law provides otherwise.
CONTRACT LANGUAGE
The contract language is German.
FINAL PROVISIONS
Should any of these provisions be or become invalid, the validity of the remaining provisions shall not be affected.

AREA OF APPLICATION AND CUSTOMERS
These terms and conditions apply alone to orders made by customers via our online shop http://www.radubaias.com (hereafter Radu Baias Design Store). We do not accept dissenting conditions on the part of the customer of third parties, unless we have expressly accepted their validity. The Radu Baias Design Store range of products is expressly directed at the consumer (every natural person finalizing the contract in a manner which cannot be assigned to his or her commercial or self-employed occupational activity, §13 BGB).
OFFERS AND PRICES
The depiction of the products on the online shop does not represent a legally binding offer, rather a non-binding online catalog. Unless otherwise specified as a firm quotation, any offer made by Radu Baias Design Store shall be subject to confirmation and not binding. The acknowledgment of the order by Radu Baias Design Store shall override the purchase order and unless the customer disagrees immediately in the event of any objection, the contract shall be governed by the acknowledgment of the order. Governing prices are those quoted in the acknowledgment of the order or, insofar as no acknowledgment is given, the prices of the valid price list at the given time. All prices quoted are net prices plus vat at the given valid rate, except in the case of vat – exempt sales. All displayed prices include German vat of 16%. Please note that local charges (customs duty, sales tax) may occur, depending on your region and local customs duties. These charges are at your own expense.

PAYMENT
Prepayment: it is possible to pay via prepayment. As such ones transfers the price given in the ordering process into the specified account. The account will be specified in the confirmation of order and the product will be delivered once payment has taken place.
Paypal: Paypal is an online payment process that works via linkage with a bank account or credit card. To be able to pay via Paypal it is necessary to have a Paypal account, which can be opened in the process of ordering.
Credit card: to pay by credit card, it is necessary to choose the relevant card and enter the required details in the relevant fields. The credit card will be charged via stripe
DELIVERY
Delivery takes place within the delivery deadline given on the relevant page in regards to the address to which the product is to be delivered by DHL. Regarding prepayment the deadline given for delivery begins the day the full price is paid (including vat and shipping costs), when paying via Paypal it begins as soon as receipt of payment has taken place, with credit card payments the deadline begins with the confirmation of order. You will receive your order, as far as possible, in one shipment. Should it be necessary, due to technical or logistical reasons, to send your order in more than one shipment, no extra cost will be accrued.
RIGHT OF REVOCATION
It is possible to return the received products without reason within 14 days by post. The deadline begins after receiving the parcel. Only with non-package postable products (eg bulky goods) is it possible to communicate a desire to return the product in written form. The punctual posting of the product or the written desire to return is enough to observe the deadline. Product return and the written desire to return are to be addressed to:

The received product and as well the payment are to be returned in case of an effective return. In case of deterioration and/or derived use, the product can be returned in part or only in a deteriorated state, it is necessary to give us compensation for lost value. Compensation for lost value has to be made only if the derived use or deterioration is in conjunction with use of the product that goes beyond inspecting the product and its characteristics. Under “inspecting the product and its characteristics” we understand the testing and sampling the product in question as is usual in a store. Refund commitments must be met within 14 days. The deadline begins for the customer with the sending of the product or a written desire of return, for us it begins when we receive either.
The right of revocation does not apply to orders that have been customized with an embossing on the product.
RESERVATION OF PROPERTY RIGHTS
Products remain our property until payment has taken place.

In accordance with its obligation to report any defect under section 377 HGB (german commercial code) the customer has to inspect the goods immediately upon receipt and notify Radu Baias Design Store in writing of any detectable defect without delay. Any hidden defects shall be reported to Radu Baias Design Store immediately upon their detection otherwise these shall be deemed accepted.
In the case of any defect quality Radu Baias Design Store may at its discretion provide a new replacement free of any defect, or it may rectify the defect detected, before the customer may assert any other right under sections 434ff BGB. Should the customer intend the futile expiration of a period of grace or final deadline set by the customer to result in the rescission of the contract or a reduction of the remuneration, this consequence shall be expressly threatened by the customer in writing when setting the grace period or deadline. The deadline shall be set so that it allows Radu Baias Design Store at least two attempts at rectification.
The warranty period is 12 months from the date of delivery.
GUARANTEE
Relevant legal commissions apply in case of defective goods.
APPLICABLE LAW
Agreements are governed by the law of the federal republic of Germany in exclusion of the unbuying law, as far as no binding international consumer protection law is in opposition.

FINAL PROVISIONS
Should single stipulations be or become invalid, none of the other stipulations will become invalid.
